soukeník – štrpka Successfully Defended the Slovak Republic in a EUR 280 Million Dispute

Law firm soukeník – štrpka successfully defended the client’s position in legal proceedings in which it represents the Slovak Republic, acting through the Healthcare Surveillance Authority.

The Bratislava IV Municipal Court delivered a judgment dismissing the action brought by the private company FLOW, which had asserted against the Slovak Republic a claim for payment of EUR 280 million plus accessories, and awarded the client full reimbursement of the costs of the proceedings.

The subject matter of the dispute was substantial financial compensation for damage sought by the claimant against the Slovak Republic. In its decision-making, the court examined whether the statutory conditions for the state’s liability for damage caused by an unlawful decision had been satisfied. Following a thorough review of the case, it concluded that, in the circumstances at hand, the basic prerequisites for entitlement to compensation for damage had not been met. The court accepted the arguments advanced by law firm soukeník – štrpka and also upheld the firm’s objections concerning the expert evidence submitted by the claimant in the proceedings.

In the court proceedings, the client was able to rely on an experienced team specialising in arbitration and litigation, led by the firm’s partner Lukáš Štefánik. An important member of the team was the head of the case team – senior attorney Barbora Ivanová.
