Theory of Law

If, in German legal theory, Ernest Rudolf Bierling is regarded as the first true German legal theorist, and in Czech legal theory František Weyr, then Jozef Prusák must be regarded as the first true Slovak legal theorist, whose Theory of Law ranks among the cornerstones of Slovak legal theory. In the mid-1960s, a new generation of legal theorists arrived at the Bratislava department, with Jozef Prusák becoming its key figure, a teacher and scholar who shaped entire generations of Slovak lawyers. He was the first in the field of legal theory, through his scholarly work, to direct attention to its central questions: the interconnection between the normative form of law and its actual operation, the relationship between positive law and morality, as well as a range of challenges of legal dogmatics. The culmination of Prusák’s focus on the central themes of legal theory is also this first Slovak textbook on legal theory, which was first published in 1995. Original in both its structure and content, the book remains relevant even today. The purpose of republishing Prusák’s Theory of Law is to preserve its significance for future generations of lawyers.
