Law firm soukeník — štrpka s. r. o. achieved success in representing its client, Všeobecná zdravotná poisťovňa, a.s. (VšZP).
VšZP, together with the Ministry of Health of the Slovak Republic, was a defendant in court proceedings concerning protection against allegedly unlawful conduct in competition. The subject matter of the dispute concerned objections raised by private health insurance companies to the conduct of state authorities and the state health insurance company in connection with the increase of share capital and the subsequent use of such funds by VšZP.
In the dispute, the client was able to rely on an experienced team specialising in arbitration and litigation, led by the firm’s partner Lukáš Štefánik. An important member of the team was the head of the case team – senior attorney Barbora Ivanová. The team thoroughly analysed all legal aspects of the case and prepared a comprehensive procedural strategy that took into account the specific features of a dispute concerning protection against unfair competition and regulation in the field of public health insurance.
The court of first instance dismissed the action in its entirety and awarded the client full reimbursement of the costs of the proceedings. The decision confirms the correctness of the client’s conduct and that of its shareholder – the Slovak Republic, represented by the Ministry of Health of the Slovak Republic – in complex legal matters governing the activities of health insurance companies.
